What is the federal criminal process?
Normally it starts with an FBI agent or some law enforcement agent from a federal agency coming by and seeing you. That tips you off right away you’re in trouble. Eventually you will get arrested and you will be indicted by a federal grand jury. You will then go to court, which is the United States District Court.
The federal cases, the reason they’re so different is because they’re trial by ambush. In state court we know who the witnesses are and we question the witnesses before trial. In federal court you don’t have that right. You’ve got to rely even more on your lawyer in federal court, so you need to find somebody who’s familiar with that kind of practice to know how to do a trial by ambush.
